Provider: Artefacto LLP, a company registered in England and Wales], with registered office at 86-90 Paul Street London EC2A 4NE ("we", "us", "our").
By creating an account or using our services, the business entity you represent ("you", "your", or "Customer") agrees to be bound by these Terms.
1. Our Service
We provide a software-as-a-service (SaaS) platform for businesses to collect, manage, and publish impact stories and other feedback from their customers (the "Service").
Subject to these Terms, we grant you a non-exclusive, non-transferable right to access and use the Service during your subscription term.
2. Business Use Only
This Service is provided solely for business purposes. You confirm that you are acting on behalf of a business and not as a consumer.
You are responsible for all activity under your account and for ensuring your authorised users comply with these Terms.
3. Customer Content
You retain all rights to the testimonials and content you collect or upload ("Customer Content").
- You have obtained all necessary permissions to use, store, and process Customer Content.
- Your Content does not violate any applicable law or third-party rights.
You grant us a limited, non-exclusive licence to use, process, and store Customer Content solely to provide and improve the Service.
4. Data Protection
Your role and ours: When you use our Service to collect testimonials, you are the data controller and we are the data processor. This means:
- You decide what personal data to collect and how to use it
- We process that data only according to your instructions
- You're responsible for having legal basis to collect testimonials (e.g., consent from your customers)
Our commitments as your processor:
- We process personal data only as necessary to provide the Service
- We implement appropriate technical and organisational security measures
- We will assist you with data subject requests (access, deletion, etc.) where reasonably possible
- We will notify you of any data breach affecting your Customer Content
- We will delete or return personal data upon termination (unless legally required to retain it)
- We use trusted third-party service providers (such as cloud hosting, email delivery, and payment processing) who are also bound by appropriate data protection obligations
Both parties will comply with UK GDPR and the Data Protection Act 2018. These data processing terms form part of our agreement with you.

5. Fees & Payment
- All fees are exclusive of VAT unless otherwise stated.
- Subscriptions are billed in advance (monthly or annually).
- Failure to pay may result in suspended access.
We may revise pricing with 30 days' notice.
6. Acceptable Use
You must not:
- Send spam or misleading messages
- Fabricate testimonials
- Reverse-engineer the platform
- Break any applicable laws using the Service
We may suspend your account for serious or repeated breaches.
7. Intellectual Property
We retain all rights to the Service, software, and branding. You may not copy, distribute, or resell the Service or use our trademarks without permission.
8. Term & Termination
These Terms apply from the date of acceptance and remain in force until terminated by either party.
- Either party may terminate with 30 days’ written notice
- We may suspend or terminate your access for material breach
- We may delete your data 30 days after termination
9. Warranties & Disclaimers
We provide the Service with reasonable care and skill but do not guarantee uninterrupted or error-free operation.
Except as stated, all warranties are excluded to the fullest extent permitted by law.
10. Limitation of Liability
We are not liable for indirect or consequential loss. Our total liability is capped at the amount you paid us in the 12 months prior to the claim.
Nothing limits liability for death, personal injury, or fraud.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales.
12. Changes
We may update these Terms. Material changes will be communicated in advance. Continued use means acceptance of changes.
